South Africa Grants Diplomatic Immunity to BRICS Attendees for Upcoming Meetings

South Africa’s Department of International Relations and Cooperation has announced that it will provide diplomatic immunity to all participants of the upcoming meetings involving BRICS (Brazil, Russia, India, China, and South Africa). The decision aims to ensure the protection of conference attendees and the smooth functioning of the events. The department emphasised that this conferment of immunities is a standard practice applied to all international conferences and summits held in South Africa, irrespective of the level of participation.

In a statement released on Tuesday, the department clarified that the diplomatic immunities granted were for the conference as a whole and not for specific individuals. The immunities are designed to shield the conference and its participants from the jurisdiction of the host country during the duration of the events. However, it is important to note that these immunities do not override any warrants issued by international tribunals against conference attendees.

The decision to provide diplomatic immunity comes after the department issued a notice in the government gazette on Monday, in accordance with the Diplomatic Immunities and Privileges Act. The act serves as a legal framework to safeguard the privileges and immunities of foreign diplomatic personnel and international organisations in South Africa. The upcoming BRICS foreign ministers meeting, scheduled to take place in Cape Town in June, and the BRICS summit in Johannesburg in August were specifically mentioned in the notice.

BRICS, an emerging-market bloc that includes Brazil, Russia, India, China, and South Africa, plays a crucial role in fostering cooperation and economic growth among its member countries. South Africa assumed the presidency of BRICS on January 1, 2023, succeeding China.

The decision to grant diplomatic immunity to BRICS attendees aligns with South Africa’s commitment to hosting successful international conferences and summits. By offering this protection, South Africa aims to create an environment where participants can engage in open and productive discussions without concerns about potential legal implications. This move is crucial in maintaining the spirit of international cooperation and ensuring the effectiveness of the upcoming BRICS meetings.

While diplomatic immunity shields participants from the host country’s jurisdiction during the conference, it is important to emphasise that it does not exempt individuals from any existing warrants issued by international tribunals. The department’s statement made it clear that attendees are still subject to international legal obligations and any judicial processes initiated by relevant international bodies.

The conferment of diplomatic immunity is a well-established practice in the context of international conferences and summits. It serves as a safeguard to ensure that delegates can participate freely without fear of legal repercussions. South Africa’s decision to provide diplomatic immunity to BRICS attendees reflects its commitment to hosting successful and productive international gatherings, promoting diplomatic relations, and contributing to the overall goals of the BRICS partnership.
